Alternative Dispute Resolution

Litigation can be an inhibiting cost to business, as such we aim to help client reduce exposure whenever possible.

Our lawyers are highly experienced legal practitioners who frequently represent clients in ADR processes, including acting as mediators and arbitrators. The firm’s dispute resolution lawyers are familiar with arbitration and negotiation rules as prescribed under the Kenyan regulatory framework, whether by non- binding, binding, court appointed, independent or international arbitration.

Where a settlement cannot be agreed through straightforward negotiation, but the parties involved still wish to avoid court proceedings, we provide commercial mediation and arbitration, which is a much faster, less costly and less acrimonious than pursuing redress through the courts.

The firm’s Managing partner is an experienced arbitrator of international repute and standing and has heard and determined complex commercial disputes that had been referred to arbitration.

Part of our approach includes working closely with our clients to determine the best dispute resolution process to meet their needs – our clients have increasingly found that the privacy, flexibility and relative speed of ADR make it a logical choice in business disputes of all kinds, including those featuring complex financial issues.

We keep an open mind as to how we can best – and most cost effectively – secure our clients’ goals, advising them on the proper drafting of ADR provisions for both domestic and international transactions.
